最近、とある定年本*1を読んでいて、「再雇用よりも業務委託を受ける方が、自由に気ままに、会社に縛られずに働ける。『独立請負人』として働いてみてはいかが？」というような趣旨のことが書いてあった。
そうなのかな？

Both Company and Contractor agree that Contractor is an independent contractor to Company. Nothing contained in this Agreement shall be construed to create any relationship between Company and Contractor, such as employment or agency. As Contractor is not an employee of Company, Contractor shall not be entitled to, for example, but not limited to, any wage, salary, retirement benefit, social and/or private insurance or any other benefit entitled to the employees of Company. Company shall not be responsible for and Contractor shall indemnify Company with any liability, caused by or in the performance of Contractor whatsoever whether under this Agreement or not.

建設契約などの請負契約によくみられるものです。
条項名は「Independent Contractor 」だけではなくて「Relationship of Parties(当事者の関係)」とした上で：
「この契約は、両当事者による法的なパートナーシップや代理関係を創設するものではなく、両当事者はそれぞれが "independent contractor" なのである」
という規定する場合もある。
ぼくは日本語の直訳である『独立』とか『請負人』に、あまり期待と希望をこめた意味を見出すべきではないと思っています。
